Wealthwatch Special OOTW Chat  8-9-15  Part 3 of 5

OOTW: Section II: the Federal Supreme Court Article (93): The Federal Supreme Court have the following duties: First, control over the constitutionality of laws and regulations.

Second, the interpretation of provisions of the Constitution.

Third chapter in the issues that arise from the application of federal laws, decisions, regulations and instructions, and procedures issued by the federal authority, the law guarantees the right of each of the Council of Ministers, and stakeholders, individuals and others, the right of direct appeal to the Court.

chattels: typical language defining the province of the judiciary so far

whitelions: It;s the amendments that get you lol

chattels: my read is that any citizen can directly appeal to the court on such issues

OOTW: YES
~~~
OOTW: MY FOCUS IS THE POTENTIAL THAT THE SJC MAY RULE ON ANY MATTER (ALSO) OF CONCERN ALSO BY THE COM
OOTW: AND THAT UNDER THIS AMENDMENT THAT THE COM MY BRING FORTH AN APPEAL BEFORE THE SJC
chattels: recall that last year a direct appeal was sucessfully taken on the constitutionality of the term limit law for the Prime Minister
OOTW: HOPING THAT THIS CURRENT ACTION BY ABADI AND CREW TO ADDRESS CORRUPTION WOULD BE THAT "APPEAL"
OOTW: YES
chattels: hoping for an appeal of the Abadi reforms ?
OOTW: YES
chattels: arguably the better course for us is that the actions taken by Abadi with the consent of the COM or Parliament are NOT appealed
OOTW: THIS FALLS UNDER THE FEDERAL JUDICIARY SECTION OF THE CONSTITUTION
OOTW: YES, PERHAPS A MISUSE OF THE WORD APPEAL BY ME...MY INTENTION IS THAT THESE ACTIONS MIGHT BE SEEN AS A PLEA BEFORE THE SJC BY THE COM
OOTW: Sixth: Settling accusations against the president of the Republic, and the Prime Minister, ministers, and is regulated by law.
chattels: the likelihood is that Abadi and company have already sought and obtained a preliminary opinion from the court upon the reform laws, we shall see
chattels: an opinion as to their constitutionality in advance
Iraqi Prime Minister Haider al-Abadi’s decision to make extensive political reforms to eliminate the post of vice president and other high-ranking positions in the government caused different reactions among Iraqi factions Sunday.
Disgraced former Prime Minister and sitting Vice President Nouri al-Maliki, whose position will be eliminated under the Abadi proposal, said in a statement to the press he will support Iraqi Shiite leaders’ calls for change in the government.
He asked the Iraqi premier to implement the reform. Salim Jabouri, the head of the Iraqi Parliament, in a statement vowed to stand by the Iraqi premier in his new plan to reduce high-ranking positions.
“The Iraqi Parliament will fully support the government’s reform and will be an observer to the process,” Jabouri said. He added the reforms should take place in accordance with the law.
The Sadrist Movement in Iraq in a statement welcomed Abadi’s plan, and asked its MPs and ministers to support the premier to implement the reforms.
Kurdish Iraqi MP Zana Rosta'ee for his part told Rudaw the announced reform would be ineffective without first amending the Iraqi law.
 He also criticized Abadi for being swayed by Iraqi Shiite leaders and demonstrators, suggesting that Abadi’s decisions are emotional and may stir up political conflicts more than before. Abadi’s decision comes days after Iraqis took to the streets across the country demanding better services and an end to corruption.
 “The decisions are good but success in implementing such reforms requires law adjustments,” Rosta'ee said. “This kind of unilateral reform by the Iraqi prime minister may bring a kind of dictatorship to power.” In a statement, Abadi said that the n
chattels: or are we talking about some other legislation on corruption specifically ?
JethroTexasTea: http://ift.tt/1Ny5Ort... http://ift.tt/1MVgR0X
JethroTexasTea: well if Maliki supports Abadi's measures he supports being booted imo
JethroTexasTea: unwillingly I'd reckon
] OOTW: ‹@chattels› I WOULD HOPE SO BECAUSE THE COM ANNOUNCEMENT SPECIFICALLY STATED THAT THE SJC WAS IN SUPPORT OF THE COM'S ACTIONS
JethroTexasTea: ‹@OOTW› including Maliki himself lol
chattels: ‹@JethroTexasTea› thanks, posted earlier at wealthwatch.world/showthr...
http://ift.tt/1MiPNsB
chattels: ‹@JethroTexasTea› that is why i am wondering what the quid pro quo is for maliki ?
OOTW: JETHRO LOL -HERE'S SOMETHING TO THINK ABOUT
JethroTexasTea: ‹@chattels› probably some sorta deal involving him or his son possibly
 OOTW: HOW CAN THE SECTION OF THE CONSTITUTION WHICH ADDRESSES AN REQUIRED HOR VOTE TO REMOVE IMMUNITY AND/OR AN MP - IF THE PEOPLE VOTING ARE COMMITTING CORRUPTION AND THAT CAN BE PROVED?
JethroTexasTea: but sounds like the citizens want a piece of Maliki
OOTW: THIS WOULD HAVE TO FALL TO A HIGHER AUTHORITY...THE SJC
OOTW: AND THE SJC IS STATED, IN THE COM ANNOUNCEMENT, TO BE IN SUPPORT OF THE COM'S ACTIONS AGAINST CORRUPTION
chattels: ‹@JethroTexasTea› one would think that there is more to this than meets the public eye ?
JethroTexasTea: ‹@OOTW› now that's deeep
JethroTexasTea: could be...as long as he's removed and parliment can get on with moving foward then either way works
chattels: ‹@OOTW› don't the corrupt always advocate against corruption, at least publically ?
OOTW: I DO NOT SEE HOW THIS WOULD BE A REQUIREMENT - IE THE APPROVAL OF PARLIAMENT, WHICH CONTAINS CORRUPT MINISTERS, RETAIN A LEGAL POSITION IN THIS DECISION. ..THIS IS EXACTLY WHAT THEY'RE TRYING TO  BYPASS
OOTW: WE'LL SEE HOW MANY SHOW UP
OOTW: TO THE NEXT SESSION
OOTW: TRUE CHATTELS HENCE MOST OF MALIKI'S SPEECHES OVER THE PAST DECADE
OOTW: LOL
chattels: ‹@OOTW› abandoning constitutional process is dangerous no matter the worth of the objective
OOTW: I AGREE...REMEMBER THE COM HAS MADE A PRESS RELEASE THAT THEY'RE GOING TO AMEND THE CONSTITUTION WHEN NEEDED
OOTW: THEY RETAINED THE WRITE TO DO SO WHEN NEEDED
chattels: what is convenient and expeditious one day can bite one in the arse the next
JethroTexasTea: sounds like they're gonna amend it and move right along
OOTW: THE RIGHT
OOTW: SORRY MY ADD IS KICKING IN..I'M TOO EXCITED
JethroTexasTea: and post to the citizens whomever objects
JethroTexasTea: public spectacle
OOTW: YES JETHRO
JethroTexasTea: ‹@OOTW› haha
OOTW: LOL
chattels: due process of law is one of the values that the international community watches in determining the safety of investments in Iraq
OOTW: ‹@chattels› YES
tipsyterror: If indeed the PM can oust Maliki like this, why has it taken a year for Abadi to do so?
JethroTexasTea: citizens complained to Sistani to enforce a FATWA and override Abadi...Sistani then turned around and said do the right thing...Sadr said the same thing "or else"
JethroTexasTea: and now we're here
OOTW: THE MOMENTUM PROVIDED ALSO BY THE PROTESTORS AND THEY'VE STATED THEY'RE NOT STOPPING UNTIL THEY GUILTY ARE DEALT WITH
JethroTexasTea: Sistani over rules everyone over there
chattels: without due process of law it is a free for all that depends upon the Prime Minister for the moment
JethroTexasTea: Sistani runs that program over there
JethroTexasTea: and now it filters down through govt
JethroTexasTea: which is what it appears to be happening
JethroTexasTea: backwards from what we do
JethroTexasTea: the western ways
chattels: one of the constraints upon progress by Abadi has been due process and constitutionality - to circumvent it would make him no better than Maliki no matter how enlightened the cause
tipsyterror: indeed Maliki chose this same course on multiple occasions.
tipsyterror: i.e. Shabbibi
JethroTexasTea: well when you have a corrupt govt and religion dominates the environment that's how it's going
tipsyterror: et al
chattels: ‹@tipsyterror› true
OOTW: I LOOK AT IT THIS WAY....THE MOB TELLS A COHORT.."YOU HAVE OUR FULL SUPPORT - GO FOR IT" THEN THE PERSON THEY LENT SUPPORT TO DRAWS WAY TOO MUCH ATTENTION –
THEN THE MOB COMES BACK AND SAYS, "GUIDO, YOU'VE DRAWN TOO MUCH ATTENTION, WE CAN'T BE SEEN BEING CONNECTED TO THIS"...THEN GUIDO "GOES DOWN"...THIS IS THE DYNAMIC BETWEEN IRAN AND MALIKI
forestnr4: ‹@chattels› I agree. Abdi attempted for all parties to buy in on the reforms. Time is running out and he now has the green light from the religious leaders to get er done!!! With an Iron Fist!!! Clean house!!!!
JethroTexasTea: ‹@OOTW› that's a good point too....they're ready for the international scene and Maliki has no value to them anymore
chattels: ‹@forestnr4› Abadi has been building support and consensus from Sistani and others i believe and now may have both the moral, military and legislative support that he needs
chattels: best case scenario, but I am concerned about the Kurds
forestnr4: ‹@chattels› exactly!!
chattels: if the Shia and Sunni have gotten together for a majority, but without consensus from the Kurds then we may have some problems
OOTW: ‹@chattels› THAT'S NOT SUCH A WET BLANKET STATEMENT IS IT?
chattels: stepping away, this have been an exhausting discussion :)
OOTW: ;)
JethroTexasTea: ‹@chattels› they've been begging for Abadi to get rid of Maliki tho...what do you see them being concerned about? Sunnis/shia's versus Kurds sorta scenario possibly?
JethroTexasTea: lol
chattels: Budget, Article 140 and oil issues
JethroTexasTea: yea same here...need a drink and it's only 11am haha
